A SPONTANEOUS STATEMENT REQUIRES LACK OF TIME TO REFLECT
The 16-year old complaining witness told her mother that the defendant had been molesting her for 5 years. The trial judge admitted this into evidence in reliance on the spontaneous statement (also called the excited utterance) exception to the hearsay rule. EC 1240 requires there to be an exciting event.
